Bronx Prostitution Lawyer

Prostitution is a sex crime that is often considered as one of the oldest methods of making money. The laws that are in place have made what was once a legal practice decades ago illegal today. It’s illegal to solicit another person for any kind of sexual act or agree to any kind of sexual act for money. If children are involved, then the punishment for the crime can be on the higher end of the scale.

Every state has laws that make prostitution illegal except for Nevada. However, there are restrictions on prostitution in Nevada. There are states that will punish someone for the act of prostitution while others will punish someone for arranging the act or owning a home or business for the act of prostitution or finding prostitutes takes place. Transporting someone from one state to another or between two countries for prostitution is a federal crime and is usually punished by several years in prison.

There are a few people who are involved in the act of prostitution who can be charged. The person who is the provider, the person who is receiving the services and the person who sets up the meeting or act can all be charged with prostitution. The simple act of offering services for money is enough to be charged in most states. There are officers who will set up prostitution stings in order to catch as many people as they can in the act and get them off the streets for at least a short time. The person who is paying for the services is known as the solicitor and is just as guilty as the person who is offering the services. There doesn’t need to be a clear statement about what the person is offering or what the person wants to receive. As long as the actions are present and there is an indication that sexual acts are going to be exchanged for money or have been exchanged for money, then the people involved can be charged.

Solicitation of prostitution is an act that the person can be charged with as soon as an agreement is made for sex in exchange for money. Some type of action, such as getting money from an ATM, will then be needed to show that the person is intent on following through with the act. When the person encourages or arranges for a sexual act to take place, then charges of solicitation can be given. If the person is a minor, then a misdemeanor that could have resulted in probation or minimal time in jail ends up being a felony.

The punishment for prostitution will vary greatly from one state to another as some states look harshly on acts of this nature while other states tend to classify it as a simple misdemeanor. Most states will offer a sentence that ranges from one to 10 years depending on the circumstances and history of the people charged. If you have been charged with prostitution or solicitation, then speaking with an attorney is the first thing that you should do to try to get the charges reduced or dropped or to try to keep the sentence to a minimum. The attorney will look at your criminal history and why you were involved in prostitution. If there is an underlying issue, such as a mental disorder or drug use, then the attorney might be able to arrange probation and rehab instead of jail time.
