Can a religious annulment be contested?

One of the biggest misconceptions surrounding the annulment process is that it’s a quick way to get a divorce. It’s not a divorce, and it’s not always quick. It’s not just for people who have only been married for a short time, and it’s not for anyone to apply for. You can contest an annulment even if it’s for religious purposes, and you must know what to expect, how it works, and what you can do if you’re in the middle of an annulment and you want to contest.

What is an annulment?

The first thing is to realize you might not know what an annulment really is. It’s a process, and it’s something to learn prior to beginning the process. An annulment is a way to end your marriage, but it’s not like a divorce. You won’t be married anymore but unlike a divorce that merely ends your marriage, an annulment turns your marriage into something that never even happened. Your marriage license is thrown out. Can I get an annulment?

Maybe. There is no right or wrong answer to this question. You cannot get an annulment simply because you’re done with the marriage and you want to erase it. You must meet the requirements for an annulment, which are very specific.

These are all reasons you can annul your marriage, and you can also annul it if you were married younger than 18 and decide you weren’t ready. You have only four years to apply for an annulment if this is the case. If there was fraud in that your spouse told you he wanted kids but knew he was medically unable to have them prior to your marriage, you can get an annulment. If he is still married to his former wife even though he thought the divorce was final, you can annul your marriage. If he forced you to marry him or you were both drunk when you got married, you can annul the marriage.

Contesting an Annulment

If you choose to contest your annulment, there are issues you face. You cannot stop this from happening if your partner makes the decision to contest. Even though this is a religious situation for you, you can still end up married in the eyes of the church if your annulment is denied and you’re forced to go through with a traditional divorce. In the eyes of the church, an annulment is the only way to forever break the bond of marriage, and it’s not something they allow without serious consideration.

If your annulment is contested and not granted, you are free to get a divorce. However, the church will still view you as a married person even though the law knows you are not. If your spouse contests, you must be willing and able to provide evidence to support your case for the best possible outcome.
