Clavicle Fracture Accident Lawyer

The clavicle is a bone in the shape of a “V,” and it connects a person’s breastplate to their shoulder. Many people know this as their collarbone. It is a solid bone, but because of its location, and the way it’s connected to the shoulder, the clavicle is the bone in a person’s body most often broken.

Fractured Clavicle
The clavicle may be fractured when severe force is applied to a person’s shoulder. It can also become broken with impact that is directly experienced by the clavicle. Fractures often occur when people fall with their arms outstretched or when they fall on their shoulder. This is when the clavicle can be directly struck. It is possible for the clavicle to be broken at the sternum, AC joint, or midpoint. The midpoint fracture is a clavicle fracture that occurs midway between a person’s AC joint and their sternum.

Causes
There are common causes of clavicle fractures that can result in a personal injury lawsuit. Many clavicle fractures can occur during a car or motorcycle accident. It is common for this injury to happen as a result of the force of an airbag being deployed, a person being thrust against a steering wheel as well as thrown to the pavement and more. It’s also possible for a person to fall and break their clavicle as the result of negligence from an individual or entity. Many clavicle fractures occur when a person riding a bicycle is thrown over the handlebars and more.

Treatment
When a person suspects they have any type of clavicle fracture, they should immediately seek medical treatment. A person will be given X-rays by a physician. This will help them determine where the fracture has occurred and the severity of it. Once this has been done, a person could be given a sling. This will keep the clavicle area immobile during the healing process. Some individuals are given a figure-of-eight-splint. This is a type of bandaging designed to hold a person’s clavicle, as well as their shoulder, in place. In some extreme cases, a surgical procedure will be necessary. This may be required if there is more than one break or there is nerve damage. It could also be required if it is an open fracture. It’s also possible for a clavicle fracture to not heal on its own. This is also a situation where surgery may be advised by a physician.

Newborn Clavicle Fracture
A newborn’s clavicle can become fractured during a difficult labor and delivery. This can occur because of birth trauma resulting from using a vacuum or hands as will as forceps with excessive force. With a newborn, this could result in complications. With the clavicle of a newborn being fractured, their brachial plexus could also be damaged. This is a group of nerves in the newborn’s body that connects their spinal cord to their hands and arms. Should a baby experience a fracture of their clavicle and is unable to rotate their arm, it is an indication their brachial plexus was damaged. These types of injuries vary greatly in severity. Most brachial plexus injuries in newborns are serious and will require significant treatment.

Parental Rights
It does not matter what health care provider a woman has during her labor or delivery. They do have a right to experience competent medical care. Should a mother not receive reasonable care, and their child suffer as a result; they have a right to compensation. A parent should be compensated for all their child’s medical bills associated with the injury. Should a parent have lost time at their work or be required to spend extra money for childcare services, they should be compensated for it. If a parent must travel so their child can receive medical care, they should also be compensated for those expenses as well as pain and suffering and more.

In many cases, a clavicle fracture is a common injury. It can also result in a person experiencing significant complications. These fractures can be the result of negligence from a person or entity. When this happens, a person is entitled to compensation for their losses and injuries. An experienced and knowledgeable attorney will know how to analyze a case. They can determine a course of legal action to obtain the best possible results for their clients.
