Is CBD illegal to possess

Originally thought not to be pharmaceutically active, the substance is now known to have a number of unique medicinal properties. Still, despite the large body of evidence that CBD may have useful therapeutic benefits for a wide range of ailments, it has been classified as a Schedule I controlled drug by the Controlled Substances Act. The DEA, a federal agency, therefore considers the drug to be illegal and has as its official policy the enforcement of the Controlled Substances Act against anyone who possesses or attempts to sell CBD. The Food and Drug Administration, however, has approved CBD for the treatment of two rare forms of childhood epilepsy.

What is CBD?

CBD is an oil that is extracted from the cannabis plant. It is a completely different compound from the most well-known and highly psychoactive ingredient in marijuana: THC. CBD has some effects that may counteract the negative side effects of THC. It can help people relax, and it has been used on an experimental basis in alcohol and drug withdraw patients. However, the substance does not have the same psychoactive properties of THC. Therefore, users of CBD often get many unique medical benefits, but they do not get the high and sense of euphoria that is often associated with smoking the marijuana plant itself.

CBD has been used on an experimental basis to fight everything from epilepsy to chronic pain. It has shown huge potential as a pain reliever and anxiolytic, making it a prime candidate for further research as the legal environment becomes more permissive.

What is the legal status of CBD?

Because CBD is an extract of cannabis and it contains none of the other psychoactive ingredients of the plant, it can be a little tricky trying to navigate the complex web of laws that govern its use. At the federal level, there is no ambiguity about the illegality of CBD. The DEA considers it illegal and has the right to enforce laws against its possession, use and sale whenever the agency sees fit. However, in practice, the DEA has virtually never gone after individual users for marijuana infractions, especially in states where the use of cannabis has been declared legal.

At the state level, the laws can be far more ambiguous. If you live in a jurisdiction where cannabis is legal for recreational use, it is almost certain that CBD is legal there as well. In states where medical marijuana has been legalized, CBD is usually obtainable by those possessing a medical marijuana license.

But CBD is also legal in a large number of states that do not permit the use of marijuana. Unfortunately, the mishmash of state laws regarding CBD is so extensive and detailed that it simply cannot be quickly summarized. If you live in states that do not permit even medical marijuana, especially in the South, then it is best to check your local state laws to see when and how CBD may be legal to use.
