NYC Domestic Violence and Offense Sentencing Lawyers

There are often hundreds, if not thousands, of cases involving domestic violence in New York City. Hiring an attorney from the Spodek Law Group can often be beneficial as the punishments for domestic violence can vary from no time spent in jail to spending years in jail depending on your criminal history and the nature of the crime. The court system defines domestic violence as a crime that is committed within the confines of a relationship. This could be a relationship between a parent and a child, roommates, or a married couple. The nature of the relationship doesn’t matter as much as the fact that there is a relationship of some kind between the people involved that is considered intimate in nature to some degree. Sometimes, domestic disturbances involve loud conversations that are mistaken for fighting or arguing if a neighbor or someone close to the people involved witness the activity taking place. Domestic violence can involve a number of elements but is usually surrounded by some kind of physical violence. Threatening physical violence can also constitute a domestic violence charge. Examples include strangulation and hitting.

Since there are various components involved in a domestic violence case, it’s important to seek the assistance of an attorney who can offer advice about what kind of evidence to present as well as whether to accept a plea if there is sufficient evidence against you in the case. Some charges are listed as misdemeanors while others are considered Class A felonies. Each different charge carries different punishment options, such as fines and a designated length of probation or several years spent in prison.

Most domestic violence offenses are considered felonies. The degree of the felony will usually depend on the nature of the crime and the severity of any injuries that the victim received during the violent act. Your criminal background will play a part in the sentence you receive. The judge could also consider the type of relationship that you have with the victim as well as any remorse that you show. When you speak with an attorney, you should mention any domestic violence classes that you have taken or are enrolled in as well as any positive steps you have taken to rectify the situation on your own. Even after getting out of jail or prison, you could still be on probation to some degree. There are also fines usually associated with a domestic violence offense and conviction. These fines usually include restitution that is paid to the victim.

Misdemeanors are classified as either a Class B or A depending on the type of act. You will usually be sentenced to one year or less in jail for either misdemeanor classes. Your attorney could try to negotiate a plea with the prosecution so that you only receive probation depending on your background. Felonies range from a Class E to a Class B. The most time that you would spend in prison is 25 years which is associated with a Class B felony. Most probation terms range from three to five years.
